Federal Crimes

Common cases where you may be charged with a federal crime in California:

1) Your crime violates the U.S. criminal code
2) You committed a crime against federal property
3) You committed a crime and crossed state lines 

Common federal crimes are fraud offenses, embezzlement and drugs. In some cases you can be charged in both a state court and federal court. In the case of federal charges against you it's best to seek the advice of a lawyer.

Under the Violent Crime Control and Law Enforcement Act of 1994, the "Three Strikes" statute (18 U.S.C. § 3559, provides mandatory life in prison if a convicted felon:

(a) has been convicted in federal court of a "serious violent felony"

(b) has two or more previous convictions in federal or state courts, at least one of which is a "serious violent felony."

A serious violent felony is defined as any act that seriously harms or kills another person such as murder, manslaughter, sex offenses, kidnapping, robbery and any offense which includes an element of the use of force which carries a prison sentence of 10 years or more.
